In late December 2023, Special Counsel Jack Smith filed a motion in the court handling the Washington, DC criminal case against Donald Trump for attempting to overthrow the 2020 election. The motion requests that the court prohibit certain defenses and evidence from being raised in the trial. Although at the time of this recording the trial is held in abeyance due to an ongoing motion to dismiss, this motion was filed in anticipation that the case would be proceeding to trial.
